On Sunday, January 8th, Local 399 held a specially called Commercial Meeting to discuss the last, best and final contracts offered by the AICP. Drivers and Locations Professionals were invited to attend. Both proposed contracts were reviewed and discussed at great length with Members in attendance and a vote was taken to decide whether to ratify at this meeting or vote a strike action.

As stated in the communications surrounding the event, the administration reviewed the offer and took questions from both groups. Then a discussion ensued to see if the Membership wanted to ratify that day, or if the voting preferred to vote by mail ballot ratification. The Members at the meeting overwhelmingly voted to take a ratification vote at the specially called Meeting, as voting by mail would have delayed the implementation of the contracts by 4 to 6 weeks.

Below are the changes that will be made to the Commercial Drivers and Locations Contracts:

Commercial Drivers Contract:

• 5-Year Contract

• 3% raises every year effective February 5th, 2017

• Overtime: Triple Time (3x) will be paid after 18 hours

• All 4-tons are covered • Hyphenate bump increases to from $3 per hour to $4 per hour in 2017 and then to $5 per hour in 2020

• The 4th and subsequent meal penalties will now be paid at $20 per half hour instead of $15

• Veterans Day will be added as a Holiday • Hyphenates will be allowed to drive Drivable Generators

• Hyphenate Department heads will no longer be allowed to be assigned to operate a vehicle

• Cancellation of Calls is now 4pm on the day proceeding, if not a workday

• Maintenance of benefits for the life of the contract.

Commercial Locations Contract:

• 5-Year Contract

• 3% raises every year effective February 5th, 2017

• Overtime after 13 elapsed hours starting in 2019

• $60.00 a day Kit rental February 1st 2017, $65.00 a day starting in 2019

• Veterans Day will be added as a Holiday

• Maintenance of benefits for the life of the contract

• In the 3rd year (2019) Location Manager Rest Periods will become more like that of the Drivers: “There shall be a nine (9) hour rest period following all studio zone, studio and local location work assignments for Location Managers. There shall be an eight (8) hour rest period following all overnight location assignments. If at least nine (9) (or eight (8) on overnight locations) hours of rest are not provided but six (6) or more have been provided, the penalty for each invaded hour shall be $50 per hour, paid in ½ hour increments. If less than six (6) hours of rest have been provided, then the employee shall receive an additional premium equal to one-half (½) of the applicable daily rate until nine (9) hours of rest have been provided.”

Forced Call Penalties:

• Between 6 and 9 hours of turn-around you will receive $50 an hour in penalty for each hour invaded • Less than 6 hours, you will receive ½ of your Day Rate Example:

• If you are invaded 1 hour and your Day Rate is $700 you will receive the penalty of $50 an hour for your first hour worked in addition to your hourly rate of $50 for a total of $100 in compensation for the first hour.

• If you are invaded 2 hours, you would receive $50 an hour in penalties on top of your $50 an hour in wages for a total of $200 for the first two hours.

• And so on for the 3rd hour

Rest Periods of less than 6 hours:

If less than six (6) hours of rest have been provided, then the employee shall receive an additional premium equal to one-half (½) of the applicable daily rate until nine (9) hours of rest have been provided.

All changes go into effect February 1, 2017 unless otherwise stated.
